LHC Hearing on Deduction of Granted Advance Increments and Non Payment of Pensionary Benefits
Petitioner is aggrieved by inaction on part of respondent No.4 on account of non-payment of pensionary benefits. States that advance increments already granted could not be deducted in terms of the law laid down in a reported case cited as PLD 1992 Supreme court 207. when confronted with the maintainability of this petition, learned AAG states that he has no objection if this petition is transmitted to respondent no.4 who may treat it as representation and decide the same expeditiously.In view of above copy of this petition along with all annexures is transmitted to respondent no. 4 who shall treat it as representation and decide the same after affording an opportunity of hearing to petitioner and all concerned strictly in accordance with law rules and policies within period of two weeks with receipt of certified copy of this order.
