There were two justice named Mr. Justice Amir Hani Muslim and Mr. Justice Manzoor Ahmed Malik.Petitioner of this case is Wali Muhammad Nasir and Respondent is Government of Punjab School Education Board through chief secretary Punjab and others.
As per remarks of Amir Hani Muslim, we have heared the learned counsel for the petitioner. The learned law officers, present in court on our directions, walve notice. In paragraph 7 of the impugned judgment, the learned high court has held as under:-

After arguing the petition at some length the learned counsel for the petitioners are agreed and submit that the matter may be referred to the departmental promotion committee (DPC) for the considerations of the cases of the petitioners in the light of the decision dated 17-06-2010 of the learned full bench of this court passed in WP.No.9567/2007 and the honorable supreme court of Pakistan dated 14-07-2011 passed in civil petitions No.1449-L & 1450-L of 2010 with a further direction that the Departmental Promotion Committee (DPC) shall ensure that the principal of transparency is adhered to. The appointments of the posts of SST shall be made by way of promotion as also fresh recruitment as per the policy of the Government of the Punjab School Education Board. Initial recruitment to the seats in questions shall continue and the application of the applicant in CMA No. 4225/2012 shall be deemed to be pending and considered in accordance with the law/rules/merits.
2. The grievance of the petitioner is that the department is considering his promotion from the date of his upgradation and change in nomenclature. The learned counsel submits that the appointment of the petitioner has to be considered from the length of service and the intervening changes in nomenclature or otherwise need to be ignored, which in these proceedings are not being done by the department.
3. The learned law officers concedes to this proposition and states that in promotion the length of service is criteria coupled with the other factors.
4. We therefore, direct the department to consider the promotion of the petitioner from the date of his initial appointment, subject to other relevant factors. This petition is converted into appeal and allowed in the above terms.
