The Sindh High Court (SHC) on March 7th ordered for Ayyan Ali's name to be removed from Pakistan's Exit Control List. In response to this, the federal government filed a petition against the decision and rejected the High Court's demand of allowing the model to travel abroad.
On Wednesday, April 6th, 2016, the Supreme Court (SC) upheld Sindh High Court's order and asked for Ayyan's free will to travel anywhere she wants. SC has been undertaken by three judges headed by Justice Ejaz Afzal Khan, who refused to accept federal government's appeal.
SHC's order stated that Ayyan Ali has never been involved in any kind of fraud mentioned in Rule 2 of the Exit Control Rules List, that she should not be allowed to go abroad. She has not done any kind of fraud or utilized government's funds that such restriction is being applied on her.
In reference to this, the court further said:
“In the absence of any such allegations, we don’t think the respondent’s movement could be prohibited under the Ordinance or the Rules.”
Ayyan Ali was arrested on Benazir Bhutto International Airport, Islamabad last year for carrying $506,800 in her luggage. She was kept under detention for four months in the Adiala Jail of Rawalpindi. On April 6th, 2016, Justice Afzal questioned the counsel for Customs Collectorate that if there is any suspicion in the future, that the super-model will not come back. He has also said that it is not mandatory that a person will only travel for inappropriate reasons, people can also go for a holiday or pleasure trips
